JUSTICE DINESH KUMAR SINGH ORAL ORDER 19-03-2015 Petitioner is languishing in custody since 13.12.2014 in a case registered for the offences punishable under Sections 364/34 of the I.P.C.

It is alleged that daughter of the informant was kidnapped by the son of the petitioner Mantu Kumar Verma for which Saharsa Sadar P.S. Case No. 267 of 2009 was registered wherein the petitioner was also made accused. During investigation in 164 Cr.P.C statement the victim girl stated that she performed love marriage with Mantu Kumar Verma, son of the petitioner but subsequently during trial she retracted from the initial version and thereafter again the victim has been kidnapped leading to the registration of the present case.

Considering the thrust of accusation against the son of the petitioner and the fact that in earlier kidnapping

No.10495 of 2015 (2) dt.19-03-2015 2/2 case the victim has stated that she has performed love marriage with the son of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa in connection with Saharsa Sadar P.S. Case No. 705 of 2014.
