In this case, the petitioner is seeking anticipatory bail in connection with Araria P.S. Case No.1003 of 2019 registered for offence punishable under sections 341, 323, 354, 506, 504/34 of the Indian Penal Code.

Allegation has been made that the petitioner is running a tea shop and regularly some persons were using intoxication substance creates nuisance there. When the father and maternal uncle of informant objected, the accused persons started abusing the maternal uncle of informant and misbehaved with the father of informant. When the informant intervened,

Patna High Court CR. MISC. No.404 of 2020(2) dt.27-02-2020 2/2 she was also given fists and slaps by the accused persons. Looking to the facts and circumstances of the case, this Court is not inclined to grant bail to the petitioner. However, if the petitioner surrenders before the court below and prays for regular bail, the court below without being prejudiced by this order will take decision in accordance with law, preferably on the day of appearance.

With the above observation and direction, this application is disposed of.
