2. The petitioner is in custody in a case registered for the offence punishable under Sections 395 and 397 of the Indian Penal Code.

3. As per allegation in the FIR, four miscreants looted Rs.48,03,760/- from the bank at the gunpoint.

4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case He next submits that similarly situated co-accused has been granted bail by this Court passed in Cr. Misc. Nos. 27512 of 2024, 29169 of 2024 and 58126 of 2024. Petitioner is in custody since 04.05.2024 and no test identification parade has been held

Patna High Court CR. MISC. No.4087 of 2025(3) dt.19-03-2025 2/2 and chargesheet has been completed.

5. Learned APP for the State opposes the prayer for bail of the petitioner.

6. In view of the aforesaid facts as also the fact that similarly situated co-accused persons have already been granted bail and petitioner is in custody for about one year, so I am inclined to grant bail to the petitioner.

7. Let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, East Champaran at Motihari in connection with Chakiya P.S. Case NO. 135 of 2023 with condition that the petitioner shall remain present on each and every date till conclusion of the trial.
