The petitioner is apprehending his arrest in connection with Naokothi P.S.Case no.48/17 registered for offences punishable under Sections 366A/34 of the Indian Penal Code. Allegation against the petitioner of kidnapping of the minor daughter of the informant.

Submission of the learned counsel for the petitioner is that the girl has married with the petitioner and living happily and now they have given birth to an issue also, which will appear from Annexure-2.

Heard learned A.P.P. who has opposed the prayer for bail stating that the girl is still traceless and she has not appeared either before the police or before the Magistrate. .

No.4510 of 2019(2) dt.29-01-2019 2/2 Having heard both sides and considering the aforesaid facts and circumstances, this application is disposed of with direction to the petitioner to surrender along with his wife before the learned court below within a period of six weeks from the date of order and the learned court below will examine the fact separately that as to whether she has married with the petitioner as well as she has an issue and if it is found true, the petitioner shall be released on bail in connection with Naokothi P.S.Case No.48 of 2017 to his own satisfaction. With the aforesaid observation, this application is disposed of.
