Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is apprehending his arrest in connection with Ahiyapur P.S. Case No.451 of 2018 registered for the offences punishable under Sections 325/302/323/504/34 of the Indian Penal Code.

There is direct allegation against the petitioner that he assaulted with a bamboo stick at the head of the son of the informant as a result whereof son of the informant died. Other eyewitnesses have also supported the allegation before the police.

Patna High Court CR. MISC. No.1920 of 2020(5) dt.25-09-2020 2/2 Learned counsel for the petitioner submits that petitioner is aged about 68 years. False allegation is there due to some other trivial dispute.

Considering the nature of allegation against the petitioner he does not deserve anticipatory bail. Hence, prayer for anticipatory bail is refused. Petitioner may surrender and pray for regular bail.
