The petitioner seeks bail in a case registered under Sections 341, 323, 307, 504/34 of the Indian Penal Code and Section 27 of the Arms Act.

The prosecution case, in short, is that while the informant was sitting at her door, the accused persons came there and started abusing her and in consequence thereof, informant's son was assaulted. The informant's son also received fire-arm injury.

It has been submitted on behalf of the petitioner that there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 21-08-2018. Charge sheet in this case has already been submitted. Both

Patna High Court CR. MISC. No.3976 of 2019(4) dt.18-04-2019 2/2 parties are agnates. Single fire shot is alleged to have been made by the petitioner. The injury is alleged to have been caused on non-vital part of the body. The petitioner had no intention to commit murder. It has further been submitted that the petitioner may be released after completion of nine months in custody. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that after completion of nine months in custody, the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai in connection with Teghra P.S. Case No. 52 of 2018.
