JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 01-02-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is not named in the first information report but in course of investigation , one Ajay Kumar @ Ajay Mandal @ Bablu Mandal was arrested and confessed his guilt disclosing the name of the petitioner. Subsequently, petitioner was arrested and one looted mobile is said to have been recovered from his conscious possession.

The contention on behalf of the petitioner is that the aforesaid mobile had been purchased by the petitioner and, moreover, there is nothing in the first information report that the seized mobile had been looted in the alleged occurrence and, moreover, Ajay Kumar @ Ajay Mandal @ Bablu Mandal has

Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Railway Judicial Magistrate, Kiul at Lakhisarai in connection with Jamalpur Rail P.S.Case No. 26 of 2015.
