JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 27-07-2019 After some argument, learned counsel for the petitioner submits that he may be permitted to seek statutory remedy of appeal in terms of Clause 32 of the Bihar Targeted PDS (Control) Order, 2016.

Learned counsel for the State has no objection to the same.

This writ application is being disposed off with liberty to the petitioner to seek his remedy in statutory appeal before the District Magistrate, Samastipur (respondent no.2). If such an appeal is preferred by the petitioner within a period of 30 days from today, the same shall be considered on

Patna High Court CWJC No.13233 of 2017(2) dt.27-07-2019 2/2 its own merit and in case a question of limitation arises for consideration the same shall be considered keeping in mind that the petitioner was pursuing his remedy before this Court. It is expected that if the appeal is preferred, it will be disposed off within the statutory period.
