The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 363, 366/34 of the Indian Penal Code.

As per prosecution case, informant alleged that her daughter was kidnapped by the petitioner along with co-accused persons for ulterior motives.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case because he is uncle of main accused Md. Manish @ Raja, with whom victim has solemnized their marriage. Petitioner has no concern with the alleged occurrence and he lives separately from main accused.

No.2142 of 2023(2) dt.28-03-2023 2/2 Similarly situated co-accused Ganwar Kunjra @ Ganwar Hussain has already been granted bail by the Court below vide order dated 10.05.2022 in B.P. No. 389 of 2022. Petitioner has got no criminal antecedent moreover he is languishing in judicial custody since 21.11.2022.

Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as judicial custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Andar P.S. Case No. 61 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.,-IV, Siwan.
