The petitioners apprehend their arrest in connection with Sitamarhi P.S. Case No. 320 of 2019 registered for the offences punishable under Sections 272, 273, 34 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioners submits that there is recovery of 78.220 liters of foreign wine from the conscious possession of the petitioners.

In the facts and circumstances of the case, I am not inclined to grant anticipatory bail to the petitioners. Accordingly,

Patna High Court CR. MISC. No.630 of 2020(2) dt.25-02-2020 2/2 the prayer for grant of anticipatory bail to the petitioners in connection with Sitamarhi P.S. Case No.320 of 2019 pending in the court of A.D.J. II Cum Special Judge, Excise Act, Sitamarhi is hereby rejected. However, the petitioners are directed to surrender before the court below and the learned court below shall dispose of the case on the same day without being prejudiced by this order.
