JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 15-09-2021 Heard the parties through virtual court proceedings. Vide order dated 15.07.2021, report was called for from the court of learned A.C.J.M.-XIII, Saran at Chapra in connection with Daudpur P.S. Case No. 137 of 2020 regarding stage of trial in the present case which is received and tagged as Flag "B" to this petition.
In compliance thereof, a report dated 28.07.2021 sent by the Sub Judge-cum-A.C.J.M.-XIII, Saran at Chapra has been received and at Flag "B" to this application. Learned Judge, apart from the other facts, has stated that the Court of learned Sessions Judge, Saran at Chapra has rejected the bail petition of the accused Ajit Kumar Singh with the liberty to renew his prayer for bail after six months from the date of his remand in this case. From further perusal of the record, it is submitted that vide order dated 27.01.2021 passed in B.P. No. 146/2021, the accused Ajit Kumar Singh was
Patna High Court CR. MISC. No.11726 of 2021(3) dt.15-09-2021 2/2 granted bail by the Court of Learned Sessions Judge, Saran at Chapra.
Learned counsel for the petitioner seeks to withdraw this case and he submits that he has filed the present case through e-filing and therafter, the case was registered in the Hon'ble Court on 11.02.2021, but before the registration of the present case, the petitioner was allowed bail from the court below itself on 27.01.2021.
Considering the facts aforesaid, permission is granted to the petitioner to withdraw this application.
