JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 29-03-2022 By filing supplementary affidavit, learned counsel for the petitioner requests for making correction in the address portion (cause title) of the petition. He submits that instead of District as "Uttar Dinajpur", it has wrongly been typed as "Dalkhola".

Accordingly, in the cause title, in place of District "Dalkhola", it may be read as "Uttar Dinajpur". Heard learned counsel for the parties.

The petitioner seeks bail in a case registered for the offence under Section 30(a) of Bihar Prohibition and Excise Act.

832 liters of illicit liquor has been recovered from a pick-up van and this petitioner was arrested on spot from the Scorpio vehicle.

Patna High Court CR. MISC. No.2070 of 2022(3) dt.29-03-2022 2/2 It is submitted on behalf of petitioner that nothing has been recovered from the conscious possession of the petitioner. Petitioner claims clean antecedent and he is in custody since 24.10.2021. Investigation is complete.

Learned A.P.P. for the State has opposed the bail petition.

Considering the nature of allegation, clean antecedent and period of custody, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge (Excise), Khagaria in connection with Khagaria (Muffasil) P.S.
