JUSTICE VINOD KUMAR SINHA ORAL ORDER 12-03-2019 This is an application for grant of anticipatory bail in connection with Pandarak P.S. Case No. 99 of 2018, disclosing offences under Sections 304(B), 34 of the Indian Penal Code. Allegation against the petitioners, who happen to be mother-in-law and devar of the deceased, is of killing the deceased.

Submission of learned counsel for the petitioners is that the statement of the deceased had also been recorded in para-5 of the case diary, in which she categorically stated that her nighty caught fire while cooking and the petitioner no.2 had himself brought her to the hospital for treatment. Heard learned A.P.P. also, who has also not controverted the above fact.

Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Barh, in connection with Pandarak P.S. Case No. 99 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
