JUSTICE RAKESH KUMAR ORAL ORDER 15-02-2016 Heard Sri Mukesh Kumar, learned counsel for the petitioners and Sri Nand Kumar, learned A.P.P. Four petitioners apprehending their arrest in connection with Ganga Bridge P.S. Case No. 77 of 2015 registered for the offence under Section 341, 323, 324, 307, 379, 354, 504 / 34 of the Indian Penal Code have prayed for grant of anticipatory bail.
Learned counsel for the petitioners submits that the informant's side and petitioners are close relatives and due to family dispute false case was instituted. It was further argued that from the petitioners' side already one F.I.R. was lodged on the
Patna High Court Cr.Misc. No.745 of 2016 (3) dt.15-02-2016 2/2 same day and as such prayer has been for extending the privilege of anticipatory bail.
On perusal of the F.I.R. it is evident that fardbyan was recorded in the Sadar hospital while the informant was in injured condition.
In view of the facts and circumstances and the nature of accusation, I do not find and ground to extend the privilege of anticipatory bail.
The petition stands dismissed.
