Heard the parties.

The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 386 and 387 of the Indian Penal Code.

According to F.I.R., the petitioner allegedly demanded ransom from the informant on mobile call. It is alleged that the petitioner was earlier involved in a theft case. Petitioner has admitted that he was accused in another case, in Para-3 of the bail petition.

Case diary reveals that a written letter was sent to the informant demanding ransom and the villagers suspected that the letter was written by the petitioner. Some others stated that the petitioner has got criminal association, whereas some of the

Patna High Court CR. MISC. No.2128 of 2020(4) dt.10-09-2020 2/2 witnesses have stated that the maternal aunty of the petitioner had transferred a land in favour of a man of the informant which was not liked by the petitioner and just to pressurize petitioner had threatened the informant.

Considering the nature of allegation and material available against the petitioner, in my view, this is not a fit case for grant of anticipatory bail.

Hence, prayer for bail of the petitioner is refused in connection with Nanpur P.S. Case No. 386 of 2019 pending in the Court of learned S.D.J.M., Pupri, Sitamarhi. However, in the event of surrender of the petitioner, prayer for regular bail shall be considered on its own merit without being prejudiced by this order.
