JUSTICE VINOD KUMAR SINHA ORAL ORDER 29-03-2019 This is an application for grant of anticipatory bail in connection with Complaint Case No. 571 of 2017, disclosing offences under Sections 498(A), 406, 379, 506 of the Indian Penal Code and Section 3⁄4 of the Dowry Prohibition Act. Case is under Section 498(A) of the Indian Penal Code and as both the parties have appeared and although the case has been referred to the Patna High Court Mediation Committee and the report of Mediation Committee is now available, which is at Flag 'A', which shows that the parties have resolved their dispute.
Submission of learned counsel for the petitioner is that now both the parties are residing together and they have
Patna High Court CR. MISC. No.5934 of 2019(3) dt.29-03-2019 2/2 amicably settled the dispute between them.
Heard learned A.P.P. as well as learned counsel for the complainant, who have also supported the aforesaid version. Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Vaishali at Hajipur, in connection with Complaint Case No. 571 of 2017, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
A copy of memorandum of agreement attached with the mediation report be also sent to the court below for his perusal.
