The petitioners apprehend their arrest in Pothia P.S. Case No. 216 of 2014, registered for the offences punishable under Section 307 and other Sections of the Indian Penal Code. The informant alleged that his brother had taken Rs. 1,70,000/- from Jiyaul Haque son of Qaium. The accused Jiyaul Haque called brother of the informant, but the accused persons confined the informant and his brother inside the room. The informant made specific allegation that Jiyaul Haque assaulted his brother with sharp edged weapon.
It is submitted that no specific allegation is made against the petitioner and other similarly situated co-accused persons namely Mainul and others have already been enlarged on
Patna High Court Cr.Misc. No.13679 of 2015 (2) dt.08-05-2015 2/2 anticipatory bail vide order passed in Cr. Misc. No. 1844/15. Considering the facts aforesaid, the petitioners above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Kishanganj in connection with Pothia P.S. Case No. 216 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Prabhat Kumar Jha, J.) KKSINHA/- U T
