JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 19-07-2022 Learned counsel for the petitioner is directed to remove all the defects pointed out by the Stamp Reporter within one month. Heard learned counsel for the petitioner as well as learned APP for the State.

The petitioner apprehends his/her arrest in connection with Ranitalab P.S. Case No. 222 of 2019, registered for the offences punishable under Sections 341, 457, 354, 323, 34 of the Indian Penal Code.

As per allegation, the petitioner entered into the house of the informant and attempted to outrage her modesty. Learned counsel for petitioner has submitted that petitioner is innocent and he is a person of clean antecedents. He has submitted further that as a matter of fact the father of the petitioner

Case No. 35 of 2008 lodged for the offences under Section 302 of the Indian Penal Code and the present petitioner and his mother were working in the house of accused persons of that case and on their instance the present case has falsely been lodged against the petitioner.

Considering the above-mentioned facts and circumstances as well as the clean antecedents of the petitioner, let him, in the event of his arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Judicial Magistrate, 1st Class, Danapur in connection with Ranitalab P.S. Case No. 222 of 2019, subject to the conditions as laid down under Section 438(2) Cr.P.C. Office shall ensure that all defects are removed by the petitioner within the stipulated time provided in para-1 hereinabove, failing which the matter shall be brought to the notice of this Court.
