1. Heard learned counsel for the petitioners and learned A.P.P. for the State.
2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 447, 341, 323, 354, 379, 307, 504 and 34 of the Indian Penal Code.
3. Learned counsel for the petitioners submits that petitioner no. 1 is a person with clean antecedent and petitioner no. 2 has antecedent of two cases and on account of dispute relating to property, the present false case has been instituted implicating the petitioners by the informant. It is further submitted that petitioners are own uncle of the informant and specific allegation of assault is against Amarjeet Rai who has
Patna High Court CR. MISC. No.10095 of 2024(2) dt.28-02-2024 2/2 been granted the privilege of anticipatory bail by an order dated 15.02.2024 in Criminal Miscellaneous No. 4317 of 2024. It is next submitted that the case of the petitioners are on a better footing.
4. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.
5. Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Muffasil P.S. Case No. 293 of 2022 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
