Mr. Sajid Salim Khan, S.C.-25 ====================================================== CORAM: HONOURABLE THE CHIEF JUSTICE ORAL ORDER 22-01-2020 Being aggrieved by and dissatisfied with the judgment and decree dated 22.3.1980 passed by Shri Rajendra Prasad Rai, the 3rd Additional Subordinate Judge, Chapra in Money Suit No. 3 of 1977 (Daroga Rai Vs. The State of Bihar and others), the appellant has preferred the instant appeal.
Graciously, without going into the question of plaintiff's entitlement, as agreed for payment of Rs. 51,000/- (Fifty one thousand) on lump sum basis, toward settlement of claims raised by the plaintiff, which amount the plaintiff has also accepted, the present appeal is disposed of on mutually agreed terms.
Learned Advocate General states that the payment
Patna High Court FA No.470 of 1980(11) dt.22-01-2020 2/2 shall be remitted directly into the Bank Account of the plaintiff or any of his authorized legal heir(s), for which, the particulars of the Bank Account shall be furnished to Shri Sajid Salim Khan, learned Standing Counsel. Remittance be made within four weeks thereafter.
The suit is decreed in the aforesaid terms against the judgment and decree dated 22.3.1980 passed in Money Suit No. 3 of 1977 (Daroga Rai Vs. The State of Bihar and others). Let the decree be prepared accordingly.
The appeal is accordingly disposed of.
