Petitioner apprehends arrest in a case registered for the offences punishable under Sections 341, 323, 354A, 354B, 354D/34 and 504 of the Indian Penal Code.

It is alleged that this petitioner along with other F.I.R. named accused persons, in the state of intoxication, tried to sexually assault the informant.

Learned counsel appearing for the petitioner submits that both petitioner and the informant are students of B.A.LL.B. at Chanakya National Law University of the Batch of 2018-23 and due to some petty dispute between them, this false and concocted has been lodged against the petitioner. He next submits that as a matter of fact, informant namely, Astha

No.4844 of 2023(3) dt.07-04-2023 2/2 Agnihotri and her two friends who were allegedly accompanying her at the time of occurrence are spoiled brats and aggressive in nature, they often consumed alcohol and created ruckus in the University Campus. He further submits that on 20.10.2022, informant and her two friends thrashed a girl after consuming liquor for which Jakkanpur P. S. Case No. 592 of 2022 has been lodged against them. It is further submitted that the petitioner has been suspended by the University and thus, he has already been sufficiently punished. Considering the aforesaid facts and circumstances, let the above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-VIII, Patna in Jakkanpur P. S. Case No. 391 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
