1. Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner apprehends his arrest in connection with Muffasil P.S. Case No.293/2022 registered for the offence punishable under Sections 447, 341, 323, 354, 379, 307, 504 and 34 of the Indian Penal Code.
3. Learned counsel for the petitioner submits that petitioner is a person with clean antecedent. It is next submitted that the father of the petitioner and father of the informant are own brothers as such the petitioner and the informant are cousin brothers and having dispute relating to land for which civil proceedings are going on. It is also submitted that no doubt it is alleged that petitioner assaulted the informant with an iron rod

The learned counsel submits that the petitioner has been falsely implicated though he was not even present at the place of occurrence. It is next submitted that even presuming what has been alleged is true without admitting then the injury caused to the injured is simple in nature and blow was not repeated and on account of dispute relating to land, the petitioner along with his family members came to be implicated.
4. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.
5. Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Judge-V-cumA.C.J.M.-II, Samastipur in connection with Muffasil P.S. Case No.293/2022, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
