JUSTICE AMARESH KUMAR LAL ORAL ORDER 02-06-2015 Heard the learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners seek bail in a case registered for the offence punishable under Sections 147, 148, 149, 341, 323, 324, 379, 307, 504 and 506 of the Indian Penal Code. The allegation is that the accused including the petitioners armed with weapons came to the house of the informant and assaulted Abhay Kumar, son of the informant and took away the box containing money.

It is submitted that there is no specific allegation of overt act against the petitioners. The specific allegation of assault is against the co-accused Biyas Yadav @ Kare Yadav and Laddu

Patna High Court Cr.Misc. No.15243 of 2015 (2) dt.02-06-2015 2/2 Yadav. The petitioners are in custody since 21.01.2015 having no criminal antecedents.

Considering the facts and circumstances of the case, let the above-named petitioners be released on bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of Sri A. Kumar-II, Judicial Magistrate, 1st class, Udakishunganj, Madhepura in Chausa (Fulaut) P.S. Case No.148 of 2014 with the following conditions : 1.

One of the bailors will be the close relative of the petitioners.

The petitioners will not indulge in similar or in any other offence.

3.

The petitioners will be well represented in the court.

4.

In case of absence for two consecutive dates or in violation of the terms of the bail, their bail bond will be liable to be cancelled by the court concerned.
