This application for grant of anticipatory bail arises out of Madhubani Town P.S. Case No. 137/2015, disclosing offences under sections 189, 203, 209, 327, 353, 387, 506 of the Indian penal Code.

The petitioner has criminal antecedent. It has come in course of investigation that the petitioner compelled one Jaideo Brauten, a co-accused, to telephone the Chairman, Juvenile Justice Board, Madhubani for undue favour in connection with a matter pending before him, using the name of the then sitting Judge of this Court.

Patna High Court Cr.Misc. No.1059 of 2016 (4) dt.08-03-2016 Considering the nature of accusation and the fact that the petitioner has criminal antecedent, I am not inclined to grant him privilege of anticipatory bail.

This application is, accordingly, rejected.

The petitioner is directed to surrender before the court below within six weeks from today and seek regular bail, if so advised. If he does so, his application for regular bail shall be considered on its own merit, without being prejudiced by rejection of present application for grant of anticipatory bail.
