JUSTICE PARTHA SARTHY ORAL ORDER 15-07-2021 Heard learned counsel for the petitioner and learned A.P.P. for the State through video conferencing. The petitioner has filed the instant application for grant of regular bail in connection with Kudra P.S. Case no. 309 of 2020 registered under sections 414, 401 and 413 of the Indian Penal Code.

As per allegation in the F.I.R., it is stated that while investigating with respect to three other cases, seeing the police personnel five accused persons including the petitioner herein made an attempt to escape. Two of the accused persons managed to escape, however, three of them including the petitioner herein were caught. A stolen motorcycle and a mobile phone was recovered.

It is submitted by learned counsel for the petitioner

Patna High Court CR. MISC. No.11891 of 2021(2) dt.15-07-2021 2/2 that no incriminating article has been recovered from the petitioner's possession. He has been falsely implicated in the case and also remanded in three other cases. The petitioner is in custody since 4.10.2020 and investigation in the case has concluded.

The application for bail is opposed by learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the submissions made on behalf of the petitioner together with the petitioner having remained in custody for over 9 months and investigation in the case having concluded, the Court is inclined to enlarge the petitioner on bail. The petitioner is directed to be enlarged on bail in connection with Kudra P.S. Case no. 309 of 2020 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Kaimur at Bhabhua.
