====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 17-01-2019 Heard learned counsel for the petitioner and the State.
The petitioner seeks bail in Supaul P.S. Case No. 630 of 2018, instituted for the offence under Section(s) 366(A) and 34 of the Indian Penal Code.
In the written report it is alleged that daughter of informant was kidnapped by this petitioner and Nandlal Chudhary. The victim girl after recovery has given statement under Section 164 Cr. P.C. copy of which, has been enclosed as Annexure-3 wherein she has stated that she went to Saharsa by bus with Nandlal Choudhary. She lived in Saharsa with Nandlal Choudhary in a room for five days. Thereafter, she lived in Patna till 22.11.2018. Nandlal Choudhary thereafter got her seated in a bus for Supaul from Patna.
Patna High Court Cr.Misc. No.2271 of 2019(2) dt.17-01-2019 2/2 In this manner from the statement of victim girl recorded under Section 164 Cr. P.C. it appears that she has intimacy with Nandlal Choudhary and she lived with him. Petitioner is in custody since 3.11.2018 having clean antecedent.
Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Supaul, in connection with Supaul P.S. Case No. 630 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner.
