JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 11-01-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is named in the first information report on the accusation that he along with other co-accused set the informant's hut on fire and also humiliated her by calling her caste name. Learned counsel for the petitioner drew my attention towards the impugned order of the court below and submitted that one small hut of the informant was found at the Khaliyan of the petitioner and therefore, the aforesaid fact goes to show that there was land dispute between the parties and moreover, petitioner is in jail custody since 20.11.2015.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named,

Patna High Court Cr.Misc. No.879 of 2016 (2) dt.11-01-2016 2/2 be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of SubDivisional Judicial Magistrate, Pupari at Sitamarhi in connection with Bajpatti P.S.Case No. 209 of 2015.
