The petitioner seeks bail in a case under Section 376 and other Sections of the I.P.C.

The petitioner is alleged to have committed rape with the victim.

It is submitted that the medical examination has not corroborated the allegation made by the victim. The victim was examined by the doctor and the doctor found different injuries on the person of the victim. Almost all the witnesses have stated that the petitioner committed rape with the victim. Considering the facts aforesaid, I am not inclined to enlarge the petitioner on bail. Accordingly, the same is rejected in

Patna High Court Cr.Misc. No.13171 of 2015 (3) dt.30-06-2015 2 / 2 Kesaria P.S. Case No. 122 of 2014, pending in the court of the learned J.M. Motihari.

The Trial Court is directed to expedite the trial and conclude the same within nine months from the date of receipt of this order. If the trial is not concluded within stipulated period, the petitioner may renew his prayer for bail.
