Petitioner is named in the first information report but it appears from perusal of the fardbeyan of the informant as well as impugned order that none of the witnesses claims to have seen the actual killing of the deceased and it is only stated that petitioner and some other accused were seen going towards south from where sound of firing was heard by the informant.
