2. The petitioner has preferred this application for grant of regular bail in connection with Simraha P.S. Case No. 110 of 2024 dated 04.09.2024 registered for the offences punishable under Section 21(c) of the N.D.P.S. Act.

3. As per the prosecution case, total 2 litres Eskuf Syrup was recovered from the gas repairing shop of the petitioner.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. It is submitted that nothing has been recovered from the conscious possession of the petitioner and he has no concern with the alleged recovery. Learned counsel for the petitioner has

5. Learned A.P.P. for the State has opposed the bail petition of the petitioner. It is also submitted that the petitioner is habitual offender and Simraha P.S. Case No. 03 of 2024 was lodged against the petitioner under NDPS Act.

6. Considering the aforesaid facts and circumstances of the case and submissions of learned counsel for the parties, I am not inclined to grant bail to the petitioner and the same is rejected.
