After some argument, Mr. Arun Kumar Singh, learned Counsel appearing for the appellant, has submitted that the substantial question of law as framed in this appeal, at the time of admission, cannot be sustained in view of the Bench decision of this Court in the case of Mahomed Usman Khan v. Amir Main & ors. (AIR 1949 Patna 237).

Nobody has appeared on behalf of the respondents. In view of the aforesaid submission on behalf of the appellants, this Second Appeal is dismissed.
