18.07.2016 Heard learned counsel for the petitioner and learned counsel for the State.
The petitioner is languishing in custody since 15.12.2014 in connection with Darpa P.S. Case No. 21 of 2012 pending in the Court of Judicial Magistrate, 1st Class, Raxaul at Motihari, East Champaran for the offences instituted under Sections 147, 148, 149, 341, 324, 504 and 307 of the Indian Penal Code and Section 27 of the Arms Act.
The earlier bail application of the petitioner was rejected vide Cr. Misc. No. 19268 of 2015 dated 31.07.2015. This is the second attempt for bail on behalf of the petitioner.
Petitioner is in custody since 15.12.2014. Charge-sheet has been submitted in the case. There is no allegation of tampering of evidence
Patna High Court Cr.Misc. No.2014 of 2016 (2) dt.18-07-2016 against the petitioner. There is also land dispute between the parties. The other co-accused have been granted bail vide Annexure-4 series to the present application. The matter has been compromised between the parties vide Annexure-5 to the present application.
On behalf of the State, it has been submitted that the petitioner is named in the FIR.
Considering the aforesaid facts and circumstances of the case, let the petitioner, above named be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri N. K. Priyadarshi, Judicial Magistrate, 1st Class, Raxaul at Motihari, East Champaran or his successor in connection with Darpa P.S. Case No. 21 of 2012.
