The petitioner, being the step son of the informant is apprehending arrest in a case registered for the offences punishable under Sections 341, 342, 448, 323, 379, 498A and 354B/34 of the IPC.
The prosecution case, as per the written report of Chanda Devi, dated 14.04.2018, submitted to the Station House Officer, Bettiah Mahila Police Station, is to the effect that the father of the petitioner, namely, Jagdish Singh, after death of his first wife, the mother of the petitioner, performed second marriage with the informant. It is specifically alleged that the informant
Patna High Court Cr.Misc. No.3105 of 2019(2) dt.05-02-2019 2/3 used to pressurize to transfer the land in favour of the petitioner. On 26.03.2018, all the accused persons including the petitioner came and dragged the informant, badly assaulted her and took away the articles including a cow from her house. It is submitted by learned counsel for the petitioner that the thrust of accusation is against the father of the petitioner, who has been granted privilege of anticipatory bail by a co-ordinate Bench of this Court, vide order dated 25.01.2019, passed in Cr. Misc. No. 3709 of 2019. It is further submitted that there is no specific accusation against the petitioner.
Learned counsel for the State submits that the petitioner is named in the FIR.
Considering the nature of accusation and the fact that the thrust of accusation is against the father of the petitioner, who has been granted bail, let the above named petitioner be released on anticipatory bail in the event of arrest/surrender before the learned Court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned Additional Chief Judicial MagisttrateVII, West Champaran at Bettiah in connection with Mahila Bettiah P.S.
