JUSTICE DINESH KUMAR SINGH ORAL ORDER 15-02-2016 Heard learned counsels for the petitioner and learned APP for the State.
The petitioner is languishing in custody since 30.08.2015 in a case registered for the offences punishable under sections 302, 304B, 498A/34 of the Indian Penal Code in connection with Masarakh P.S. Case No.234/2015, pending before the learned CJM, Saran at Chapra.
Prosecution case is of killing the sister of the informant within six years of marriage for non-fulfillment of dowry demand of rupees one lakh by causing burn injuries. It is submitted by learned counsel for the petitioners that accusation of demand of dowry after six years of marriage appears to be absolutely unreasonable and the victim committed suicide.
Patna High Court Cr.Misc. No.1631 of 2016 (4) dt.15-02-2016 2/2 Considering the fact that the post-mortem reflects 100% burn injuries and the thrust of accusation is against the husband of the victim, this court is not inclined to grant bail to the petitioner at present. Accordingly, the application for bail on behalf of the petitioner is rejected.
