JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 08-02-2024 Heard learned counsel for the petitioners and learned A.P.P appearing on behalf of the State. The petitioners are languishing in custody in a case registered for the offences punishable under Sections 420, 467, 468, 471, 120(B), 34 of the Indian Penal Code and Sections 66(b) and 66(d) of the I.T. Act.

It is alleged that on getting information that some persons are involved in cyber crime and trying to

Patna High Court CR. MISC. No.4488 of 2024(2) dt.08-02-2024 2/3 cheat the innocent people in the name of advancing the loan, raid was laid and seven accused persons including the petitioners were arrested.

It is submitted by learned counsel for the petitioners that petitioners are innocent and they have falsely been implicated in this case. No incriminating material has been recovered from the conscious possession of the petitioner. The petitioners claim the seized mobile phones to be their own mobile phones. The petitioners are languishing in custody since 09.11.2023. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. In contra, learned A.P.P appearing on behalf of the State has vehemently opposed the prayer for bail of the petitioner.

Considering the facts aforesaid and the period under custody, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) each with two sureties of the like
