JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 09-03-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Allegedly, two country made loaded pistols, one mobile and some cash were recovered from conscious possession of the petitioner.
The contention on behalf of the petitioner is that the seized cash belongs to the petitioner and so far as so-called recovery of mobile and arms are concerned, the same is nothing but only plantation of the police to implicate the petitioner in a false case. It is contended on behalf of the petitioner that two cases are said to have been registered against the petitioner prior to institution of this case and as a matter of fact, petitioner was not aware about the institution of the aforesaid cases and when he was
Patna High Court Cr.Misc. No.9212 of 2015 (2) dt.09-03-2015 2/2 caught in the present case, he was remanded in Forbesganj P.S.Case No.332 of 2014 but up till now he has not been remanded in Forbesganj P.S.Case No.260 of 2011 and the above stated conduct of the police officials reflects their intention. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Araria in connection with Forbesganj P.S.Case No. 332 of 2014.
