Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State as also heard learned counsel, appearing for the informant.

The petitioner is named in the first information report and there is allegation against the petitioner and rest four accused persons that they assaulted the informant as well as his brother by means of Lathi and Danda but from perusal of postmortem report, it would appear that the deceased sustained only one injury on his person and having considered the aforesaid fact, co-accused, Bhikhari Mahto and Ram Sawari Devi have

Patna High Court Cr.Misc. No.8284 of 2015 (2) dt.09-03-2015 2/2 already been granted privilege of bail by this court vide order dated 11-02-2015 passed in Cr. Misc. No. 5639 of 2015. Taking into consideration the aforesaid facts and circumstances as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Gopalpur P.S. Case No. 81 of 2014 to the satisfaction of Chief Judicial Magistrate, West Champaran at Bettiah.
