JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 09-07-2018 Heard the learned counsel for the petitioner and State. The petitioner is in custody in connection with Dhaka P.S. Case No. 136 of 2018 for the offence under Sections 30(A) of the Bihar Prohibition and Excise Act, 2016. Learned counsel for the petitioner submits that the petitioner has no criminal antecedent and he is in custody since 01.05.2018 in connection with seizure of 247.5 liters of liquor. Learned counsel submits that there was no recovery from the conscious possession of the petitioner but he apprehended when he was returning from Nepal.

Considering the fact that the petitioner has no criminal antecedent, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each
