JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 11-01-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is named in the first information report with accusation that he opened fire on the brother of the informant as a result of which informant's brother sustained firearm injury on his abdomen and subsequently after 14 days of the alleged occurrence, the informant's brother died in course of his treatment. Petitioner carries criminal antecedent of 12 cases. Considering the aforesaid facts and circumstances as well as submissions of the parties, I am not inclined to release the petitioner on bail and accordingly, his prayer for bail in connection with Haspura P.S.Case No. 35 of 2011, pending in the court of Sub-Divisional Judicial Magistrate, Daudnagar stands rejected.
