JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 23-02-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 14.07.2013 on the accusation that part of looted money was recovered from the house of the petitioner.

The contention on behalf of the petitioner is that having similar allegation co-accused Kundan Kumar Pandey has already been granted privilege of bail by a Bench of this Court vide order dated 03.09.2014 in Cr. Misc. No.36658 of 2014. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of

No.7022 of 2015 (2) dt.23-02-2015 2/2 Additional Sessions Judge Vth, Patna in connection with Kotwali P.S.Case No. 364 of 2013, subject to the condition that (i) one of the bailors shall be a father of the petitioner(ii) if the petitioner is found involved in future in similar type of case, the prosecution will be at liberty to make prayer for cancellation of his bail and the court below will pass necessary order, including cancellation of bail and (iii) the petitioner would cooperate in the proceeding of the court below. In event of failure to appear on two consecutive dates, the court below will be at liberty to pass the order, including cancellation of bail bonds.
