JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 02-03-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Dumariaghat P.S. Case No. 92 of 2015, registered under Section 392 and 412 of the Indian Penal Code.

Learned counsel appearing on behalf of the petitioner submits that it would appear from the F.I.R. that petitioner is not named in the F.I.R. The name of the petitioner appeared in the confessional statement of Pradeep Yadav as detailed in paragraph no. 31 of the case diary. Thereafter, the godown of the petitioner was also searched by the Police, but no incriminating article has been recovered from there. Further submission is that petitioner has no criminal antecedent and he is in custody since 02.09.2015.

Patna High Court Cr.Misc. No.1830 of 2016 (3) dt.02-03-2016 2/2 Further submission is that similarly situated co-accused, namely, Shravan Yadav has already been granted privilege of bail by a coordinate Bench of this Court vide order dated 21.01.2016 passed in Criminal Misc. 54225 of 2015.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, East Champaran at Motihari in connection with Dumariaghat P.S. Case No. 92 of 2015.
