JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 15-02-2022 The learned counsel for the petitioners is directed to remove all the defects pointed out by the office within one month. Heard the learned counsel for the petitioners and the learned Additional Public Prosecutor for the State through video conferencing.
The petitioners apprehend their arrest in connection with Raniganj P.S. Case No. 169 of 2020 registered for offence punishable under sections 341, 342, 354 (B), 353, 379, 504, 506/34 of the Indian Penal Code.
The learned counsel for the petitioners has submitted that the FIR was lodged after two days of the occurrence, which

In this case, the case diary was called for. The xerox copy whereof is available with the record. Paragraph 24 of the case diary shows that the petitioner was directed by the police to appear before the court below and he has furnished the P.R. bond before the police and thereafter, charge sheet has been submitted. Considering the above mentioned facts and circumstance, the present anticipatory bail petition is not maintainable and accordingly, it is disposed of. The petitioner is directed to surrender before the court below and make a prayer for regular bail and if he files a petition for regular bail before the court below, his prayer for regular bail shall be considered, if possible, on the same day, in the light of pronouncement of the earlier orders of this Court as well of the Hon'ble Supreme Court.
Office shall ensure that all defects are removed by the petitioners within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this Court.
