The petitioner seeks bail in a case under Sections 363, 365 and 366A of the Indian Penal Code.

The informant Amisha Kumari made allegation that while she was standing under Rajendra Nagar Over bridge waiting for an auto-rickshaw, the petitioner came and took the informant on his auto-rickshaw. Thereafter the driver speeded up the autorickshaw and took a turn towards By-pass. It is submitted that the occurrence took place on 16.10.2014 but the F.I.R. was lodged on 17.10.2014. The victim received minor injuries whereas the petitioner got his hand fractured. It is submitted that the petitioner is in jail since 17.10.2014 and chargesheet has already been submitted. It appears that the petitioner was driving the vehicle

Patna High Court Cr.Misc. No.10147 of 2015 (3) dt.02-04-2015 2/2 after taking wine and he made an attempt to kidnap the minor victim girl. The petitioner has already remained in jail for six months and he has no criminal antecedent.

Considering the facts aforesaid, the above named petitioners are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Krishna Gopal, Judicial Magistrate, 1st Class, Patna in Patrakar Nagar P.S. Case No. 248/2014.
