In this case, the petitioner is seeking bail in connection with Trial No. 2766 of 2015 arising out of Complaint Case No. 295C of 2014 registered for offences under sections 376/511 and 354(B) of the Indian Penal Court. The Magistrate has taken cognizance under Section 342, 354, 354A and 352 of the Indian Penal Code.
A complaint case has been filed wherein the Complainant has stated that the petitioner has tried to outrage the modesty of his daughter. The victim girl (daughter of the Complainant) gave a teeth bite whereupon the petitioner fled
Patna High Court Cr.Misc. No.6552 of 2016 (2) dt.01-03-2016 away. When the matter could not be materialized in Panchayati, the complaint case was filed.
Learned counsel for the petitioner submits that the victim girl or her parents could have approached directly to the police. The Complainant has lodged the Complaint after ten days of the occurrence. The court below did not find any material with respect to attempt of rape and also has not taken cognizance under that section.
Looking to the fact that the petitioner is in custody since 25.8.2015, let the petitioner, namely, Bablu Padit @ Bablu Pandit be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Bettiah, West Champaran in connection with Trial No. 2766 of 2015 arising out of Complaint Case No. 295C of 2014.
