This application, for grant of anticipatory bail, arises out of Mahila Bettiah Police Station Case No. 06 of 2018, disclosing offences under Sections 341, 342, 448, 323, 379, 498A, 354B/34 of the Indian Penal Code.

The informant is the second wife of the petitioner. It is alleged that the informant and the petitioner were married after the death of the first wife of the petitioner. There is allegation of assault and torture and pressure being made on the informant for transfer of a piece of land held by the informant in favour of the sons of the first wife of the petitioner.

Patna High Court Cr.Misc. No.3709 of 2019(2) dt.25-01-2019 2/2 Considering the nature of accusation, in my view, a case for grant of anticipatory bail is made out. Accordingly, this application is allowed.

Let the petitioner, above named, in the event of his arrest or surrender before the Court below within four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-VII, West Champaran, at Bettiah, in connection with Mahila Bettiah Police Station Case No. 06 of 2018, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bond shall be liable to be cancelled.
