The petitioner seeks bail in anticipation of her arrest in connection with Majhaulia P. S. Case No. 347 of 2017 dated 11.09.2017 instituted for the offences under Sections 409 and 34 of the Indian Penal Code. The petitioner in the capacity of headmistress of the Primary School is alleged to have withdrawn an excess amount of Rs. 1,05,550/- from the fund allocated for building construction.

Learned counsel for the petitioner has submitted that the amount has already been deposited and no dues

Patna High Court Cr.Misc. No.3868 of 2019(2) dt.25-01-2019 2/2 certificate has been obtained by the petitioner. Considering the aforesaid aspects, the petitioner, above-named, is directed to be released on bail, in the event of her arrest or surrender before the court below within a period of four weeks from the date of receipt / production of a copy of this order, on her furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bettiah , West Champaran in connection with Majhaulia P. S. Case No. 347 of 2017, subject to the conditions as laid down under Section 438 (2) Cr.P.C. (Ashutosh Kumar, J) skm/- U
