The petitioner being the husband of the victim is languishing in custody since 20.11.2014 in a case registered for the offences punishable under Sections 498A, 323, 307 and 326/34 of the Indian Penal Code. Subsequently, section 304B IPC was also added.

The accusation is of killing the daughter of the informant after five years of the marriage for non-fulfillment of the dowry demand.

It is submitted by learned counsel for the petitioner that the victim eloped with one Shivanand Tiwary for which father of the petitioner lodged Jakkanpur P.S. Case No. 402

Patna High Court Cr.Misc. No.14215 of 2015 (02) dt.27-04-2015 2/2 of 2014 making accusation under Sections 363 and 366 of the Indian Penal Code but subsequently Shivanand Tiwary deserted the victim and hence, she committed suicide and on conclusion of investigation charge-sheet has been submitted under Section 306 of the Indian Penal Code.

It is submitted by learned counsel for the informant that the victim was killed after five years of the marriage by causing burnt injury.

Considering the fact that the charge-sheet has been submitted under Section 306 of the IPC when substantive case was lodged for the elopement of the victim with Shivanand Tiwary at earlier point of time, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Danapur, District - Patna in connection with Naubatpur P.S. Case No. 569 of 2014.
