The petitioner seeks bail in connection with NCB/PZU/V/04/2019 (Special Case No. 07 of 2019, registered for offence punishable under Sections 8, 20, 25 and 29 of the Narcotic Drugs and Psychotropic Substance Act, 1985. Learned counsel appearing on behalf of the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. He further submits that the alleged recovery has not been made from the conscious possession of the petitioner but recovered from the truck in question. The petitioner has no criminal antecedent and he is in custody since 17.01.2019.

Patna High Court CR. MISC. No.1609 of 2020(2) dt.23-01-2020 2/2 Learned A.P.P. appearing for the State opposes the prayer for bail and submits that the huge quantity of Ganja has been recovered from the alleged truck.

Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, I am not inclined to grant bail to the petitioner.

Accordingly, this application is rejected.
