JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-02-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner happens to be driver of the truck in question in which sheep were carried by other co-accused and on the basis of confessional statement of petitioner, the looted sheep were recovered.
Contention on behalf of the petitioner is that petitioner was directed by his employer to carry the sheep in his truck and according to direction of his employer, he carried the aforesaid sheep and moreover, petitioner helped the police in getting the sheep recovered. It is further contended by him that petitioner does not have any criminal antecedent and is
Patna High Court Cr.Misc. No.937 of 2016 (3) dt.19-02-2016 2/2 languishing in jail custody since 16.09.2015. Regard being had to the facts and circumstances of the case as well as submissions of the parties, I am not inclined to release the petitioner on bail and hence, his prayer for bail in connection with Durgawati P.S. Case No. 193 of 2015 pending in the court of Chief Judicial Magistrate, Kaimur at Bhabua stands rejected.
