JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-03-2019 Petitioners seek bail in anticipation of their arrest in connection with Obra P.S. Case No. 96 of 2017, registered for the offences punishable under Sections 302/34 of the Indian Penal Code.

Allegation against the petitioners, who happen to be brother-in-law and sister-in-law of the deceased, is of causing death of the deceased in collusion with other accused persons. Learned counsel for the petitioners has drawn my attention towards Annexure-3 which reveals that prior to death the statement of the deceased was recorded by the Magistrate where she has stated that accidentally her sari caught fire and due to which she received injuries and further paragraph 99 of the case diary also discloses that the Officer-in-Charge of Lanka

Patna High Court CR. MISC. No.2412 of 2019(3) dt.25-03-2019 2/2 P.S. call the learned Magistrate for recording her statement. Further submission is that co-accused, who is father-in-law of the deceased, has been granted privilege of anticipatory bail by this Court vide order dated 8.3.2019 in Cr.Misc.No. 3768 of 2019.

Heard learned APP and learned counsel for the informant. They have opposed the prayer for anticipatory bail of the petitioners.

Having heard both sides and in the facts and circumstances, the provisional anticipatory bail granted to the petitioners vide order dated 18.1.2019 is, hereby, confirmed in connection with Obra P.S.Case No. 96 of 2017, pending in the court of Sub-Divisional Judicial Magistrate, Daudnagar, Aurangabad.
